DMCA Copyright Policy
Last updated: October 2026
1. Introduction
DepartWith ("we," "us," or "our") respects the intellectual property rights of others and expects users of departwith.com (the "Platform") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using the Platform when those claims are reported to our Designated Copyright Agent as described below.
If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a DMCA takedown notice to our Designated Copyright Agent using the procedure set out in Section 2.
Not legal advice. This policy is provided for informational purposes only and does not constitute legal advice. If you have questions about your specific situation, we encourage you to consult a qualified intellectual property attorney before submitting a notice.
2. Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice, your written communication must include all of the following elements, as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work. A description of the copyrighted work (or works) that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
- Identification of the infringing material. A description of the material you claim is infringing and that you want removed or disabled, along with information reasonably sufficient for us to locate the material — such as the specific URL(s) on departwith.com where the alleged infringing content appears.
- Your contact information. Your full legal name, mailing address, telephone number, and email address so that we and, if applicable, the user who posted the content can contact you.
- Good-faith statement. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement. A statement that the information in your notification is accurate, and — under penalty of perjury — that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature. A physical or electronic signature of the copyright owner or the person authorized to act on behalf of the copyright owner.
Please send your completed takedown notice to our Designated Copyright Agent:

Email: dmca@departwith.com
Notices sent to addresses other than the one above may not be received or acted upon in a timely manner.
Upon receipt of a complete and valid notice, we will:
- Expeditiously remove or disable access to the allegedly infringing material;
- Notify the user who posted the content that the material has been removed or disabled;
- Forward a copy of the notice (with your personal contact information) to that user so they may exercise their right to file a counter-notification (see Section 3); and
- Document the notice in accordance with our repeat infringer policy (see Section 4).
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Please ensure your claim is accurate before submitting a notice.
3. Counter-Notification
If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. Under 17 U.S.C. § 512(g)(3), a valid counter-notification must include:
- Identification of the removed material. A description of the material that was removed or disabled and the location (URL) where it appeared before it was removed or disabled.
- Statement of good faith. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information. Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which DepartWith may be found), and that you will accept service of process from the person who filed the original DMCA notice.
- Signature. Your physical or electronic signature.
Send your counter-notification to:
Email: dmca@departwith.com
Upon receipt of a valid counter-notification, we will:
- Forward a copy of the counter-notification to the original complainant;
- Inform the complainant that the removed material may be restored in 10 to 14 business days unless the complainant notifies us that they have filed an action seeking a court order to restrain the user from infringing activity; and
- Restore the removed material within 10 to 14 business days after receiving the counter-notification, provided the complainant has not filed such a court action.
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages. Please ensure your counter-notification is accurate.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, DepartWith maintains a policy to terminate, in appropriate circumstances, the accounts of users who are deemed repeat infringers.
We track valid DMCA takedown notices associated with user accounts. A user who receives multiple valid DMCA complaints — generally two or more within a rolling 12-month period — may have their account permanently suspended, regardless of whether the underlying content was removed following each individual notice.
We reserve the right to terminate any user account at any time, without prior notice, where we determine, at our sole discretion, that the account is being used to infringe the intellectual property rights of others. Account termination does not relieve a user of any civil or criminal liability that may arise from prior infringing conduct.

This DMCA Copyright Policy is provided for informational purposes only. Nothing in this policy constitutes legal advice or creates an attorney-client relationship between you and DepartWith. If you are unsure whether the content you are reporting constitutes copyright infringement, or if you need guidance on filing a notice or counter-notification, we strongly encourage you to consult a qualified intellectual property attorney before taking action.
